NEW DELHI: Government on Monday failed to get the Supreme Court agree to an early hearing of its plea to lift the stay on implementation of 27% OBC quota in Central educational institutions.
"The Bench, which had passed the stay order, is not available for some time.
If the Bench is not available we cannot help it," the court curtly told solicitor general G E Vahanvati and additional solicitor general Gopal Subramaniam when they moved the application seeking an early hearing of Centre's modification-cum-clarification position by a five-judge constitution bench.
With the UPA constituents as well as opposition parties egging the law officers to do their best to secure an early hearing on the application, they will be required to request the Chief Justice for an early setting up of a bench which must include Justices Arijit Pasayat and L S Panta, who passed the stay order.
